Who these terms are between
These terms are an agreement between you and EvalFlo Technologies Private Limited, Kolkata, West Bengal, India. If you accept them for an organization, you confirm you are allowed to bind it, and "you" means the organization too.
You must be at least 18 to use EvalFlo. The privacy policy, the cookie notice and the candidate notice form part of these terms.
Accounts and organizations
Sign-in is provided by Clerk. You are responsible for keeping your credentials to yourself and for what happens under your account. An organization's owner is responsible for who they invite and which roles they grant.
No plan counts users. Invite every reviewer you need. Candidates are not users of your organization; they are authenticated per run and never hold organization roles.
If you run a flo
You decide what to collect, how strict integrity checks are, what your rules do and who decides. Every decision that ends a candidate's run, whether a person or a rule made it, is yours and is logged.
- You must have a lawful basis for the data you collect and give candidates the notices your jurisdiction requires. Our invitation and just-in-time screens help; they do not replace your obligations.
- Automated rejection is available on scores and countable events. Some places regulate automated employment decisions; you are responsible for knowing whether that applies to you. The builder warns you when a rule reads a judge-scored stage or an integrity count.
- Integrity findings are evidence for a reviewer, never proof of cheating, and camera or microphone findings can never feed a rule. Do not present a finding to a candidate as a verdict.
- Identity documents are for late-stage or post-offer use. Asking for them early can create discrimination exposure for you; the stage defaults late for that reason.
- You must not use EvalFlo to discriminate unlawfully, to assess anyone under 18, or to collect data outside the registered assessment fields.
If you are a candidate
Taking an assessment an employer sent you is free and always will be. Your personal link resumes where you stopped. The invitation tells you what the process involves before you start, and you can ask for an alternative route to a person at any capture screen.
Submit your own work. Do not share sealed questions, and do not attempt to break out of an assessment environment. Reaching the end means your submission is complete; the employer's next steps are theirs.
Content and ownership
You own the content you write: your questions, tasks, flos and branding. You grant us a licence to host, copy and display it only as needed to run the service for you. If you publish a flo or share questions, other organizations may copy them into their own accounts, and those copies are theirs.
Platform content is ours and sealed. Selecting it gives you a black box to draw from, not the items. Reviewing a candidate's work shows their answer and score; revealing a sealed question is a separate, logged permission.
Verified is a claim we make about a specific version of a flo. Everything else is unverified and says so. Read a flo before you run people through it; verification does not replace your judgement.
Plans, billing and refunds
Every organization starts on Free. Paid plans are billed monthly or annually in US dollars at the prices on the pricing page, plus applicable taxes such as GST. Payments go through Stripe or Razorpay; in India, recurring payments follow the RBI e-mandate process, so a renewal may take a day to confirm.
A plan includes a volume of candidate runs. A run is one candidate's pass through one flo, counted when they start their first billable stage, not on invite and not on completion. Runs past the included volume are billed at the plan's overage rate. Annual plans pool the run allowance across the year.
You can cancel at any time; the plan runs to the end of the period you paid for and does not renew. Monthly fees are not refunded for a partial month. An annual plan cancelled within 14 days of its first payment is refunded in full, less any runs used beyond the Free allowance at the overage rate.
An unpaid renewal moves an organization into a 14 day grace period with the plan still working, then down to Free rather than into a lock. Nothing is deleted for non-payment, and candidates already in a flo always finish.
Seats are never billed. Candidates never pay. An organization can always export its own results.
Acceptable use
- No attempts to defeat isolation of the execution service, to probe other organizations' data, or to interfere with the service.
- No harvesting of content or candidate data, and no use of candidate data for anything beyond the hiring purpose it was collected for.
- No impersonation of an employer, and no sending through EvalFlo of messages that are unlawful or deceptive.
- No uploading of malicious files or of content you have no right to use.
We may suspend accounts that breach these terms, and we will tell you why unless the law prevents it.
What we do not promise
Assessment scores and integrity findings are inputs to your judgement. We do not warrant that they predict job performance or that a finding proves misconduct. Browser-only integrity cannot see a phone on the desk or a person off camera.
The service is provided as available. To the extent the law allows, neither side is liable for indirect or consequential loss, and our total liability to you in any twelve months is limited to the fees you paid us in the twelve months before the claim, or USD 100 if you paid nothing. Nothing in these terms limits liability that the law does not allow to be limited.
Ending the relationship
You can close an organization at any time after exporting your data. We can end an account for a serious or repeated breach of these terms, with notice where we can give it. Data is deleted on the schedule in the privacy policy.
Law, disputes and changes
These terms are governed by the laws of India. If a dispute arises, write to us first and we will try in good faith to resolve it within 30 days. If that fails, the courts at Kolkata, West Bengal have exclusive jurisdiction.
We may update these terms. For a material change we email account holders at least 30 days before it applies; continuing to use EvalFlo after that means you accept the new terms.
